A new secure file packer for RF that is free.

I sent the following to QOD.
I am a staff member on a project that could benefit the RF community greatly.

The file packer for RF is ok but is rather long winded when it comes to getting the files into it to make them secure.

Phoenix Game Protection System has authorized me to approach you with this offer.

They have an easy to use file packer that offers some extras. It is fast and easy to learn and use. It is also free of charge with custom license for RF if you accept. Reality Factory has allot of promise and is the first open source project that has had this offer made to them. PGPS has been coded already to work with RF.

This tool allows a game to be played and still keeps the files safe from those that might steal the media. It has a point and click interface that is so easy to use a child could do it. Please respond soon and let me know if you want to investigate this amazing offer. PGPS is not on the cutting edge, it is the cutting edge.

I say again that it is totally free if distributed with the RF package. There will be no charge to the RF team or its users.
It is as good as it sounds. The Phoenix team really wants to donate a free version of their program to the RF community. It would be specially licensed for the standard install of RF. The RF user would not have to do a thing to get it to work with RF. All the RF team would have to do is say yes and it would be sent to them free of charge. Then all they would have to do is place the installer for PGPS into the tools folder and post it for dowload on the RF site. That is all they would have to do. Very little time spent and absolutely no money spent.

What are your thoughts on this offer?

what does it mean by "custom license for RF" what are they wanting to add?
this is the main worry for me, if they have their own spereate licence that allows the user to have the choice to install it or not could be an idea if the licence doesnt go down too well.

I am VERY wary about gift horses. What's in it for them ??? There has to be a catch. I am getting very synical in my old age but we need to look very carefully at this before jumping in both feet first. They mention a "custom licence for RF" this does indicate some form of licence for them and the end user. Will the end user have to pay them to install any game made using RF ??? Personally I can't see any benefit for RF so I'm voting NO

wait...Phoenix Game Protection System...that reminds me... wasn't there a member of the RF community who called his firm Pheonix media?

I, like scott, would want to see its license first. If it somehow conflicts with the RF license we have a problem. Let's say the PGPS will be a part of RF, does that make the owners of the PGPS somehow owners of RF (as RF belongs to no-one currently, i think) ? I would not like that. But if let's say the license is so that it says "If the PGPS is used outside of RealityFactory, we will charge you blabla..." (i mean, it's costing money to use it 'normally', but with RF it's free) and it is clearly said that those two are owned by seperate people/companies/communities, i would have no problem with that.

In the world of software a "license" could be anything that you want. In this case it is merely a note that says that the copy that is given to RF is subject to copywright and that it is the intellectual property of the creator. That kind of stuff.

There is no catch. The PGPS team just wants to add their work into something where inde game designers can use it and have a chance to protect their work as well as the big guys. After all don't we have a right to? That was Phoenix Game Protections original intent. It was created to answer the call of the inde game community to help keep their media out of the hands of people that would use it as their own. It does an amazing job of it to.

It doesn't hurt that the Phoenix name would be on it. Thats all that they get out of it. I would hardly call that a catch though. The games that you create will not be watermarked or have anything during play that would lessen the quality of your creation.

All use of the Program is governed by the terms of this End User License Agreement ("License Agreement"). The Program is solely for use by end users according to the terms of the License Agreement. Any use, reproduction or redistribution of the Program not in accordance with the terms of the License Agreement is expressly prohibited.
END USER LICENSE AGREEMENT

	1.  Limited Use License. (See Number 11 for TRIAL VERSION Information and Number 12 for BETA VERSION(s)) Phoenix Sentry ("Phoenix Sentry") and David N. Goodman (Phoenix Sentry)(collectively referred to herein as "Licensor") hereby grants, and by installing the Program you thereby accept, a limited, non-exclusive license and right to install and use one (1) copy of the Program for your own personal use on a computer. The Program is licensed, not sold. Your license confers no title or ownership in the Program.

	2.  Ownership. All title, ownership rights and intellectual property rights in and to the Program and any and all copies thereof (including but not limited to any titles, computer code, themes, objects, characters, character names, stories, dialog, catch phrases, locations, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, any related documentation, and "applets" incorporated into the Program) are owned by David N. Goodman (Phoenix Sentry) or its licensors. The Program is protected by the copyright laws of the United States, international copyright treaties and conventions and other laws. All rights are reserved. The Program contains certain licensed materials and David N. Goodman (Phoenix Sentry)'s licensors may protect their rights in the event of any violation of this Agreement.
	3. Responsibilities of End User.
		A. Subject to the grant of license hereinabove, you may not, in whole or in part, copy, photocopy, reproduce, translate, reverse engineer, derive source code, modify, disassemble, decompile, create derivative works based on the Program, or remove any proprietary notices or labels on the Program without the prior consent, in writing, of David N. Goodman (Phoenix Sentry).
		B. The Program is licensed to you as a single product. Its component parts may not be separated for use on more than one computer. 
		C. You are entitled to use the Program for your own personal use, but you are not entitled to:
(i) 	sell, grant a security interest in or transfer reproductions of the Program to other parties in any way, nor to rent, lease or license the Program to others without the prior written consent of Phoenix Sentry or David N. Goodman (Phoenix Sentry);
(ii) 	exploit the Program or any of its parts for any commercial purpose.
	4. Program Transfer. You may permanently transfer all of your rights under this License Agreement, provided that: (a) the recipient agrees to the terms of this License Agreement, (b) you remove the Program from your computer and retain no copies of the Program, and (c) you transfer all of the Program (including all software components, the media and printed materials that accompany the Program, any code used to "unlock" the Program ("CD Key"), any Program upgrades, and this License Agreement) to the recipient.  Furthermore, you agree that you will not provide a CD Key to any third party except as part of the transfer of this License Agreement and the entire Program in accordance with the preceding sentence.
	5. Termination. This License Agreement is effective until terminated. You may terminate the License Agreement at any time by destroying the Program. Licensor may, at its discretion, terminate this License Agreement in the event that you fail to comply with the terms and conditions contained herein. This License Agreement shall automatically terminate in the event that you fail to comply with the terms and conditions contained herein. In such event, you must immediately destroy the Program.   The provisions of Sections 2, 5, and 7-12 will survive any termination of the Agreement.  
	6. Export Controls. The Program may not be re-exported, downloaded or otherwise exported into (or to a national or resident of) any country to which the U.S. has embargoed goods, or to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Commerce Department's Table of Denial Orders. By installing the Program, you are agreeing to the foregoing and you are representing and warranting that you are not located in, under the control of, or a national or resident of any such country or on any such list.
7. Limited Warranty. The entire risk arising out of use or performance of the Program and any printed material(s) remains with the User, however Phoenix Sentry warrants up to and including two (2) years from the date of your purchase of the Program that the media containing the Program shall be free from defects in material and workmanship. In the event that the media proves to be defective during that time period please contact customer support. In order to enforce the above-mentioned warranty, customer support should be informed of the defect within two (2) months following its discovery. EXCEPT AS PROVIDED ABOVE, The Program and ANY PRINTED MATERIAL(s) are provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, or noninfringement.  ANY WARRANTY AGAINST INFRINGEMENT THAT MAY BE PROVIDED IN SECTION 2-312(3) OF THE UNIFORM COMMERCIAL CODE AND/OR IN ANY OTHER COMPARABLE STATE STATUTE IS EXPRESSLY DISCLAIMED.  Some states/jurisdictions do not allow the exclusion or limitation of implied warranties, so the above limitations may not apply to you.

	8. Limitation of Liability. NEITHER David N. Goodman (Phoenix Sentry), Phoenix Sentry, ITS PARENT, SUBSIDIARIES OR AFFILIATES SHALL BE LIABLE IN ANY WAY FOR LOSS OR DAMAGE OF ANY KIND RESULTING FROM THE USE OF THE PROGRAM INCLUDING, BUT NOT LIMITED TO, LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES. ANY WARRANTY AGAINST INFRINGEMENT THAT MAY BE PROVIDED IN SECTION 2-312(3) OF THE UNIFORM COMMERCIAL CODE AND/OR IN ANY OTHER COMPARABLE STATE STATUTE IS EXPRESSLY DISCLAIMED.  I UNDERSTAND AND ACKNOWLEDGE THAT David N. Goodman (Phoenix Sentry). CANNOT AND WILL NOT BE RESPONSIBLE FOR ANY SOFTWARE OR HARDWARE FAILURES OR ANY OTHER EVENT WHICH MAY RESULT IN A LOSS OF DATA OR DISRUPTION OF SERVICE. Some states/jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply. 

	9. Equitable Remedies. You hereby agree that Licensor would be irreparably damaged if the terms of this License Agreement were not specifically enforced, and therefore you agree that Licensor shall be entitled, without bond, other security, or proof of damages, to appropriate equitable remedies with respect to breaches of this License Agreement, in addition to such other remedies as Licensor may otherwise have available to it under applicable laws. In the event any litigation is brought by either party in connection with this License Agreement, the prevailing party in such litigation shall be entitled to recover from the other party all the costs, attorneys' fees and other expenses incurred by such prevailing party in the litigation.

	10. Miscellaneous. The following terms, conditions and/or restrictions regarding the jurisdiction whose laws shall govern this Agreement, and the venue where any claims against Licensor shall be asserted are subject to the local laws of the country where the Product was purchased, and in the event of a conflict between the terms of this Agreement and such local laws, the local laws the country where the Product was purchased shall prevail. Nonetheless, this License Agreement shall be deemed to have been made and executed in the State of Georgia and any dispute arising hereunder shall be resolved in accordance with the law of the State of Georgia.  You agree that any claim asserted in any legal proceeding by you against Phoenix Sentry and/or David N. Goodman (Phoenix Sentry) shall be commenced and maintained in any state or federal court located in the State of Georgia, County of Columbia, having subject matter jurisdiction with respect to the dispute between the parties. Exclusive venue for all litigation involving David N. Goodman (Phoenix Sentry), with regard to this Agreement shall be in Columbia County, Georgia and you agree to submit to the jurisdiction of the courts in Columbia County, Georgia for any such litigation.   This License Agreement may be amended, altered or modified only by an instrument in writing, specifying such amendment, alteration or modification, executed by both you and Licensor. In the event that any provision of this License Agreement shall be held by a court or other tribunal of competent jurisdiction to be unenforceable, such provision will be enforced to the maximum extent permissible and the remaining portions of this License Agreement shall remain in full force and effect. This License Agreement constitutes and contains the entire agreement between the parties with respect to the subject matter hereof and supersedes any prior oral or written agreements.You hereby acknowledge that you have read and understand the foregoing License Agreement and agree that the action of installing the Program is an acknowledgment of your agreement to be bound by the terms and conditions of the License Agreement contained herein. You also acknowledge and agree that this License Agreement is the complete and exclusive statement of the agreement between yourself and Licensor and that the License Agreement supersedes any prior or contemporaneous agreement, either oral or written, and any other communications between yourself and/or David N. Goodman (Phoenix Sentry) regarding this Program.If any provision of this License Agreement shall be unlawful, void, or for any reason unenforceable in your country, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

	11. Trial License. You may use the Trial License version of the Program to evaluate the software's capabilities only. You may not distribute the program itself or any derivative works produced with the software for any purpose free, commercial or otherwise. This means that you may not distribute games packaged (processed) with Phoenix Game Protection for any purpose even if it is freeware.

	12. Beta License. You may use the Beta License (Trial, Standard or Pro) version of the Program to evaluate the software's capabilities only. You may not distribute the program itself or any derivative works produced with the software for any purpose free, commercial or otherwise. This means that you may not distribute games packaged (processed) with Phoenix Game Protection for any purpose even if it is freeware.

	13. Distribution. This software installer and/or the software as extracted may NOT be re-distributed without the prior written permission from David N. Goodman (Phoenix Sentry). This applies to all editions, versions and builds.

RF already has a packer which is password protected. So why do we need a commercial package ? RF is totally free
and not tied in any way to commercialsim. If you want to sell your game and don't trust our own packer you can always go to them and buy their product.
At the moment half price $24.99 introductory offer.
What they are offering is a free trial. In the licence they say you can't even give your game away for free.

bernie: you didnt read it well enough. There is a version called "Standard". It is not a trial or beta. It is a stand alone free application that locks up your files tight as a drum. It is allot wasier to use than the one that RF comes with. It can pack the entire game all at once and has more options and tools and toys than the current RF packer. It takes less than half the time to secure my game using PGPS than it does with RFvfs.exe. With PGPS I just tell it what folder to pack up and then click the button and it is all done at once.

You also missed the part of my post that say:

I invite anyone to get the free standard version and try it.

Then you can make up your own minds. Then no one can tell you what the story is because you will know. You will have a working copy and you will have paid nothing to get it. No time limits no file size restrictions.

I will tell you outright not to listen to me about the quality of the product. See for yourself.

what happens if i i want to pusblish my game, or sell it? Do i have to pay something? sorry for being over-crittical, but i would like to have everything sorted out before i try the program. (At the end i like it so much and then i cannot publish the game because i cannot pay the program)

This counts for the software i have, i guess? The client has another software, i guess (one that doesn't allow him to access my game data)? If this does apply to the client-software too, then there might be a problem, since the player cannot play teh game without having the client software. And if i just gave it to them i would be breaking the rules of the license. Again, the question is if i have to pay something if i want to publish the game or sell it.

That is refering to the PGPS program not the games that you make with it.

You cannot redistribute the PGPS program as it is extracted in any form.

If you make a game and pack it up with PGPS that is different.

I am inquiring to the PGPS team as to the details and expect an answer soon.

I just got word that if you use the Standard version of PGPS to protect your games, you can indeed sell your games any way you like.

The other file packer can be left in the RF tools folder. No one is trying to force you to use a certian piece of software and nothing else. Were not Microsoft. LOL!! :lol: :lol:

I have not sent a copy of the program to QOD. It is free for DL though on the Pheonix site. I posted the link above.

i have just had an idea, if they are willing to customize it then i think i got a solution for everyone, if its just going to be an .exe like the current rfpacker, then to have a customizable licence stating that it is completely free to use with rf only, have their licence agreement seperate to the rf's onstall licence, and every time they start their application the licence comes up with it, this keeps it seperate from the rf licence that can continue as it is, also a good clause to have in the licence is that it does not effect rf in anyway, this would put my mind at ease.

my thought behind this idea is that for those who download rf they wont be fritend off with this new licence agreement and means that if they never use this packer they dont need to know about the licene while ensureing that every time the packer is started everyone is fully awear of the licence agreement in case they have ideas about using for anything else.

maybe also having a line of code somewhere in rf that the packer searches for to make sure it is only used for rf, or even the packer searches for something unique already in RF's code.

i do belive this would be a good thing in rf, people recently have been complining about getting rf packer to work, it is old and could possibly mean its easy to hack so making a bit pointless, the speed increase and functions sound cool, will probably give it a spin soon see what its like.
